Terms & Conditions for Voice Over Production Services
By using our voice over services, you are accepting the below terms and conditions.
- Introduction:
This document outlines the Terms & Conditions for the provision of Voice Over Production services by Dave Bedson Event Production (the “Company”). By using the Company’s Voice Over Production services, the client (“Client”) agrees to be bound by these Terms & Conditions.
- Eligibility:
To engage in Voice Over Production services with the Company, the Client must be over 18 years of age.
- Payments & Fees:
Payment for the total project cost shall be due either before commencing the project, or within 7 days of an issued invoice, unless otherwise agreed in writing by the Company. The Company reserves the right to change the terms of payment and may require payment of the full amount prior to commencing work.
Overdue invoices will incur a late payment admin fee of £60 plus interest of 8% + Current BOE Base Rate until the invoice and all admin/late payment fees are settled in full. The Company also reserves the right to waive any discount applied to a quote in the event an invoice remains unpaid after the due date.
Failure to make full payment will result in debt recovery action being taken, and the cost incurred added to the amount due.
- Ownership of Rights:
The Client acknowledges that all rights to any work created by the Company, including all audio recordings, scripts, and other related materials, remain with the Company until the Client has paid the full amount due to the Company. Upon payment of the full amount due, the Client shall have the right to use and distribute the work as per the rights purchased.
- Cancellation:
If the Client cancels the project prior to its completion, the Client shall be liable for the full amount due to the Company, unless otherwise agreed in writing by the Company. The Company reserves the right to cancel the project at any time if the Client fails to pay the amount due.
- Equipment & Software:
The Company shall provide the necessary equipment and software to complete the Voice Over Production project. The Client acknowledges that they are responsible for providing the necessary scripts, guidance, and direction to the Company, prior to commencing the project, to ensure that the work meets the Client’s expectations. This includes, but is not limited to, any specific pronunciations required – including obscure names.
- Client Responsibilities:
The Client acknowledges that they are responsible for:
- Providing accurate and complete scripts and guidance to the Company, including pronunciation non-English words/names and obscure names
- Paying the amount due to the Company in a timely manner
- Ensuring that the work is used in accordance with the terms of this agreement an rights purchased
- Not making any unauthorized use or reproduction of the work
- Liability:
The Company shall not be liable for any loss or damage arising from any delays, errors, or omissions in the performance of the Voice Over Production project, unless such loss or damage is caused by the Company’s gross negligence.
- Termination:
The Company may terminate this agreement at any time if the Client fails to pay the amount due, fails to provide the necessary scripts or guidance, or breaches any of the terms of this agreement.
- Governing Law:
This agreement shall be governed by and construed in accordance with the laws of England and Wales.
- Jurisdiction:
Any disputes arising out of or in connection with this agreement shall be resolved through the courts of England and Wales.
- Changes to Terms & Conditions:
The Company reserves the right to change these Terms & Conditions at any time. Changes shall be effective immediately upon posting on the Company’s website.
- Data Protection:
The Company shall collect, store, and use the Client’s personal data in accordance with the Data Protection Act 1998 and the General Data Protection Regulation (GDPR).
- Insurance:
The Client is responsible for taking out any necessary insurance to protect against loss or damage to the work.
- Entire Agreement:
This agreement constitutes the entire understanding between the parties and supersedes all prior and contemporaneous agreements and understandings.
